Terms of Service

By creating an account or using TrackedPR, you agree to these Terms. TrackedPR — operated by CS Technologies Group LLC, a Delaware limited liability company — is an organizational tool that helps you record and visualize your physical-presence data. It is not legal, tax, or accounting advice.
1. Educational & Informational Purposes Only
TrackedPR is provided for educational and informational purposes only. The day counts, residency calculations, compliance indicators, warnings, and all other outputs are mathematical estimates based on user-entered data and publicly available statutory guidelines. They do not constitute legal advice, tax advice, accounting advice, or any other form of professional advice, and do not represent the official position of the IRS, the Puerto Rico Department of the Treasury, or any other government agency.
2. No Professional Relationship
Use of TrackedPR does not create, and shall not be construed to create, an attorney-client relationship, a CPA-client relationship, or any other professional-client relationship between you and TrackedPR, CS Technologies Group LLC, its developers, affiliates, or any third party. No communication through this application — including reports, CSV exports, alerts, or notifications — constitutes legal counsel or professional tax guidance.
3. No Guarantee of IRS or Tax Authority Outcome
TrackedPR makes no representation, warranty, or guarantee that compliance with the day-count thresholds tracked by this application will result in a favorable determination by the IRS, the Puerto Rico Department of the Treasury, or any other tax authority. Puerto Rico Act 60 bona fide residency involves a multi-factor analysis — including the closer connection test, domicile, and other facts and circumstances — that extends beyond day counts alone. Meeting the 183-day threshold is necessary but not sufficient.
4. Limitation of Liability
To the fullest extent permitted by applicable law, TrackedPR and CS Technologies Group LLC shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including but not limited to tax penalties, interest, legal fees, audit costs, or loss of favorable tax status — arising out of or related to your use of or reliance on this application. To the fullest extent permitted by applicable law, the total aggregate liability of TrackedPR and CS Technologies Group LLC for all claims arising out of or relating to these Terms or the application shall not exceed the greater of (a) the total amount you paid to TrackedPR in the twelve (12) months before the event giving rise to the claim, or (b) fifty U.S. dollars ($50). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
5. Dispute Resolution & Arbitration
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. By using TrackedPR, you and CS Technologies Group LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the application will be resolved exclusively by binding individual arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect — and NOT in court. You and CS Technologies Group LLC each waive the right to a trial by jury and the right to litigate disputes in court, except that either party may bring an individual claim in small claims court if it qualifies. You and CS Technologies Group LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any class or representative proceeding.

Map rendering uses Leaflet.js (BSD 2-Clause License). Reverse geocoding powered by Nominatim, operated by the OpenStreetMap Foundation, subject to its usage policy at operations.osmfoundation.org/policies/nominatim. Location data is stored locally on your device and is not transmitted to TrackedPR servers.
7. Eligibility & Your Account
TrackedPR is intended for adults (18 years or older). The service is designed for individuals tracking physical presence for U.S. federal and Puerto Rico tax purposes — typically U.S. citizens or residents relocating between a U.S. state and Puerto Rico. You are responsible for the accuracy of the information you enter and for keeping your account credentials secure.
8. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date and increment the version number shown on this page. For material changes you will be asked to review and agree again before continuing to use TrackedPR; otherwise, continued use means you accept the revised Terms.
9. Governing Law
These Terms, and any dispute arising out of or relating to them or to your use of TrackedPR, are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles, except where applicable consumer-protection law provides otherwise — and except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration provision above.

Your use of TrackedPR is also governed by our Privacy Policy.
